GastroLens is an AI-powered culinary tool that helps users:

• Identify a dish from an uploaded photo (with uncertainty)
• Understand the dish structure and components
• Receive preparation guidance, techniques, plating suggestions, and variations
• Optionally view nutrition estimates (ranges only)

GastroLens is a guidance tool. Results are generated automatically and may not be accurate or suitable for every situation.

4. Accounts and Authentication

4.1 Account Requirement

An account is required to use GastroLens. You may be offered a limited free experience (e.g., one free scan) before being required to create an account.

4.2 Sign-in Methods

GastroLens supports sign-in via email and third-party providers (such as Apple and Google). You are responsible for maintaining the confidentiality of your account access.

4.3 Account Security

You agree to:

• Provide accurate account information
• Keep your account secure
• Notify us promptly if you suspect unauthorized access

We are not responsible for losses caused by unauthorized access to your account, except where required by applicable law.

4.4 Account Deletion

You may delete your account from within the App’s settings. Account deletion is permanent and cannot be undone.

5. User Content (Dish Photos and Inputs)

5.1 Your Uploads

You may upload photos of dishes (“User Content”) for analysis.

You retain ownership of your User Content. However, you grant GastroLens a limited, non-exclusive, worldwide license to use, host, store, reproduce, and process your User Content solely for the purpose of providing and improving the App (including AI analysis, generating results, troubleshooting, safety, and service reliability).

5.2 Responsibility for Content

You confirm that you have the right to upload the content you submit and that it does not violate any laws or third-party rights.

Do not upload content that is illegal, abusive, hateful, sexually explicit, or infringes intellectual property rights.

6. AI Output Disclaimer

6.1 Automated Outputs

GastroLens uses automated AI systems to generate content (“AI Outputs”). AI Outputs are estimates and may be incomplete, incorrect, or misleading.

6.2 No Guarantees

We do not guarantee that:

• Dish identification is correct
• Instructions will produce a particular result
• Nutrition estimates reflect actual values
• Outputs are suitable for any specific dietary needs or restrictions

6.3 Not Professional Advice

GastroLens does not provide:

• Medical advice
• Dietary or nutrition counseling
• Allergy guarantees
• Professional culinary training or certification

You are responsible for safe cooking practices, ingredient verification, food handling, and personal dietary decisions.

7. Subscriptions and Payments

7.1 Subscription Model

GastroLens offers a monthly subscription to access premium features. Subscription terms, pricing, and available offers are shown in the App at purchase time.

7.2 Billing and Auto-Renewal (Apple)

Subscriptions are billed through Apple In-App Purchases and may renew automatically unless canceled at least 24 hours before the end of the current period (or as otherwise stated by Apple).

You can manage or cancel your subscription through your Apple ID account settings.

7.3 Free Access / Trial

GastroLens may offer a limited free experience (such as one free scan) before subscription access is required. This is not a recurring free trial unless explicitly stated in the App.

7.4 Refunds

Refund requests are handled by Apple in accordance with Apple’s policies. GastroLens does not directly issue refunds for purchases made through Apple In-App Purchases.

For consumers in the European Union, mandatory consumer protection rights remain unaffected.

7.5 Subscription Management Provider

GastroLens uses RevenueCat to manage subscription status and entitlements.

7.6 Free Access and Usage Limits

GastroLens may provide limited free access to certain features (such as an initial free scan) before a subscription is required.

Paid subscriptions may include usage limits (such as a maximum number of scans per day or other defined time period) to ensure fair use, service stability, and prevention of abuse.

Specific usage allowances are displayed within the App at the time of purchase and may be updated from time to time. Excessive, automated, or abusive usage may result in temporary or permanent suspension of access.

8. Acceptable Use

You agree not to:

• Use the App for unlawful purposes
• Attempt to bypass paywalls, authentication, or security measures
• Reverse engineer, decompile, or attempt to extract source code, models, prompts, or system logic except to the extent permitted by law
• Abuse the service via automated requests, scraping, or excessive usage that harms service reliability
• Upload content that violates others’ rights or applicable law

We may suspend or terminate access if we reasonably believe you violated these Terms.

9. Intellectual Property

The App, including its design, user interface, software, branding, and generated formatting (excluding your User Content), is owned by GastroLens and protected by intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the App unless we give you written permission.

10. Data and Privacy

11. Service Availability and Changes

Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

14. Limitation of Liability

To the extent permitted by applicable law, GastroLens shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from or relating to your use of the App.

Our total liability for any claim relating to the App will not exceed the amount you paid to GastroLens (if any) in the 12 months prior to the claim.

Nothing in these Terms excludes or limits liability where such liability cannot be excluded or limited under applicable law, including under consumer protection laws.

15. Governing Law

These Terms are governed by the laws of Spain, without regard to conflict of laws rules.

If you are a consumer in the European Union, you may also benefit from mandatory consumer protection laws in your country of residence.
